The distinction between digital and physical manifestations of a work may
be a difficult one and is certainly in need of clarification.

Let us put that one on one side for a moment. The distinction between an
abstract work and *any* manifestation of that work is a crucial one. If you
doubt me, ask your lawyer. 

The identification of abstract works separately from manifestations of
those works is already a central aspect of rights management in many
sectors. The fact that this has been historically unnecessary in the
journal sector (where there has typically been a one-to-one relationship
between work and manifestation) is not a good pointer to the future.
