Let us briefly examine some of the challenges which face intellectual property rights holders today:
Digital distribution creates opportunities for a new electronic trading environment which will challenge existing retail business models. Consumers are willing to pay to download high quality recorded sound into their homes as either “pay for play” or for outright purchase; and professional music users expect to be able to licence the use of digitised source material to use within television programmes and other audiovisual material for digital distribution.
The ability to accurately and uniquely identify creations will give rights holders greater control over their property and consequently provide better protection of their rights.
The nature of open networks such as the Internet disregard existing geographical boundaries, and hence national legislation for protecting intellectual property rights. New procedures for licensing and enforcing controls must be considered, agreed and implemented.
