장애인권리협약의 성안과 프레임경쟁 : 장애여성 단독조항 논의를 중심으로

본 연구는 CRPD 성안과정에서 한국을 비롯한 비서구국가들이 주창하였던 ‘사회개발모델’이 EU 등 서구국가들이 지향하였던 ‘차별금지모델’과의 프레임경쟁을 거쳐 CRPD의 지배적 담론으로 자리잡게 되는 과정을 규범이론과 프레임경쟁의 분석틀을 통해 살펴봄으로써 규범확산의 양방향성과 중첩성에 대한 이론적･정책적 함의를 도출하고자 한다. CRPD 성안과정에서 한국의 제안으로 시작된 장애여성 단독조항제정 논의는 협약의 목표와 성격에 대한 서구국가와 비서구국가 간 프레임경쟁의 특징을 보인다. 본 연구는 구조적･규범권력적 측면에서 불리했던 ‘사회개발모델’이 CRPD의 지배적 담론으로 발전하게 된 요인으로 자기대표성원칙(nothing about us, without us)과의 규범접목을 통한 프레임증폭과 CRPD의 상향식 거버넌스 구조에서 주요행위자로 기능한 국제시민사회와의 연대를 지적한다. 마지막으로 본 연구가 규범연구 및 한국의 규범외교에 가지는 이론적·정책적 함의에 대해 간략히 살펴본다.

This research aims to examine the process of frame competition over women with disabilities(WWD) article of the Convention on the Rights of Persons with Disabilities(CRPD). During the negotiation process for the CRPD, many of the global north countries dissented South Korea’s proposal to include a separate article for WWD, arguing that it desecrates the convention’s spirits of protecting universality of human rights. Meanwhile, most of the global south countries supported the proposal, claiming that the CRPD should urge governments to improve their poor, rights-abusing conditions for persons with disabilities(PWD). Debates over the WWD article rapidly evoled into a frame competition between the former’s ‘discrimination model’ and the latter’s ‘social development model’ for the convention per se. The research reveals that two factors were keys for the astonishing results of following ‘social development model.’ First, ‘social development model’ enhanced its legitimacy and credibility by grafting onto the CRPD’s ‘nothing about us, without us’ principle. Second, a multifaceted cooperation with global civil society and WWD advocacy networks stengthened the ‘social development model.’ The inclusion of the WWD article implies the pioneering role of non-Western actors and the global south whose entrepreneurship have often been neglected in norm diffusion studies.
