공공분쟁은 아직 형성중의 개념으로서 일의적으로 정의하기는 곤란하다. 다만, 좁게는 국가의 공공사업과 관련된 분쟁으로부터, 넓게는 ‘공중 또는 사회의 다수의 구성원들의 법적 권리나 의무 등에 영향을 줄 수 있는 이해관계에 관한 대립이 청구의사의 표시에 의하여 외부에 구체화된 경우’까지를 공공분쟁으로 이해할 수 있을 것이다.
이러한 공공분쟁은 기존의 전통적 분쟁과는 당사자나 쟁점의 복잡성이라는 면에 있어서 큰 차이를 보이고 있다. 따라서 공공분쟁이 소송제도와 같은 기존의 국가구제제도에 의하여 제대로 해결될 수 있는 지를 살펴볼 필요가 있다. 행정소송이나 민사소송, 또는 헌법소송 등을 그 내용으로 하는 기존의 국가구제제도는 분쟁의 성격에 따라서 각각 적합한 소송에 의하도록 하고 있다. 이에 대하여 공공분쟁은 그 분쟁의 성격이 복합적이어서 다양한 형태의 소송이 동시다발적으로 진행되게 될 가능성이 있다. 또한 기존의 소송제도는 주관적 쟁송구조를 취하고 있어서 법률상 원고적격을 가지지 못하나 이해관계를 가지는 공공분쟁의 당사자들을 수용할 수 없는 한계가 있다. 이러한 결과로 공공분쟁의 당사자는 국가구제에 의한 해결보다는 집단의 실력행사에 의한 자력 구제를 선호하는 경향이 강하게 나타나고 있다.
이에 대하여 최근에는 대체적 분쟁해결제도로서 조정과 중재 등이 다른 분쟁에 대하여도 해결수단으로서 많이 논의되고 있다. 그런데 대체적 분쟁해결이 항상 우월한 수단이며 공공분쟁에 있어서 가장 적절한 해결수단인지에 관하여는 의문이 있다. 따라서 공공분쟁의 해결이라는 관점에서는 한 종류의 분쟁해결절차에 집착하기보다 사건의 성격과 쟁점 및 청구의 내용에 따라서 사법절차를 비롯한 각종 대체적 분쟁해결절차를 혼합하여 유연하게 사용할 필요가 있다.
The term “public disputes” has been developed for recent years, however, it is still hard to define clearly. It can be understood just as “public policy disputes” in a very narrow sense. However, it also can be interpreted as “embodiment of the conflict of public interests by which the rights or liabilities of the public or community at large are affected”. These public disputes differ from ordinary or traditional disputes in the following manner: there are almost always a great many parties many of whom are hard to identify: the issues are very complex and diverse: the agenda of issues is not limited to what can be litigated. However, traditional schemes to resolve disputes are not intended to do these. Namely, the litigation scheme performs a limited role in a limited cases, and it can not cover non-legal issues. And, the traditional types of Alternative Dispute Resolution can not be applied on most of the public disputes, because they are inherently unfamiliar with the disputes, which disputants does not have the power to dispose of. Hence, ex ante measures, such as negotiated rulemaking, probably will be a better way to prevent public disputes, rather than ex post measures to resolve them afterwards. After the public dispute has arisen despite of ex ante measures, the flexible and hybrid types of resolution measures should be considered, because of the diversity of legal issues inherent in public disputes.
