이 연구는 최근의 영국과 미국의 범죄 프로파일링 제도의 변화양상을 분석하여 한국이 안고 있는 채용, 교육, 조직구성, 교정보호기관과의 연계 등의 문제들을 어떻게 개선하는 것이 바람직할 것인지에 대해 그 정책적 방향을 모색해보고자 한다.
첫째, 영국은 프로파일링의 민영화를 꾀하였지만, 미국은 연방수사국의 국가강력범죄분석센터의 권한으로 진행되고 있다. 둘째, 영국은 2012년 프로파일링 민영화를 추진하면서 내무부에 법의학규제관을 임명하여 프로파일러의 자격 및 프로파일링의 업무의 표준안 제시 등의 가이드역할을 하지만, 미국은 국가강력범죄분석센터의 행동과학연구 및 교육부가 담당한다. 셋째, 양국 모두 심리학을 채용조건으로 하지만 미국은 범죄학, 법의학, 사회학 등의 인접학문을 폭넓게 인정하며, 적어도 3년 이상 경찰 및 연방수사국 등 법집행기관의 근무경력을 요구한다. 넷째, 국가강력범죄분석센터의 프로파일러는 연방범죄에 대한 프로파일링 및 수사, 그리고 경찰수사의 프로파일링 업무를 지원한다. 다섯째, 양국 모두 프로파일링의 결과를 직접적인 증거로 인정하지는 않고 있다. 여섯째, 영국의 법의학규제관 및 미국의 행동과학연구 및 교육부는 범죄 프로파일링의 중심축 역할을 하며, 유관기관과 파트너십 관계를 공고하게 유지하고 있다.
이와 같은 양국의 특징을 바탕으로 한국의 범죄 프로파일링제도의 개선방향을 제안할 수 있다. 첫째, 현행 국립과학수사연구원을 국무총리실로 그 소속을 이전하고 독립시켜 가칭 국가과학수사원을 설치하여 과학수사와 관련한 법령 및 기술, 전문자격 등 전반에 걸친 연구와 지원을 총괄토록 한다. 둘째, 인력보강 및 조직정비로 권역별 프로파일링 팀제를 도입하여야 한다. 셋째, 범죄 프로파일러 신규채용 조건의 학위 이수커리큘럼을 제시하고, 경찰 및 교정보호기관의 프로파일러 인턴십제를 운영하여야 한다. 넷째, 기존 범죄분석관들의 재교육은 수사경찰과 함께 참여하는 콜로키움이나 브레인스토밍 등과 같이 소규모로 반복적으로 시행함으로써 상호 정보를 공유하는 기회로 전환되어야 한다. 다섯째, 범죄분석관과 수사경찰과의 사건정보 공유규정을 강화하고, 교정보호시설에서도 프로파일링이 가능하도록 관련법을 정비해야한다. 여섯째, 경찰과 검찰, 국과수에서 개별적으로 진행된 범죄분석 자료를 상호 공유하는 데이터베이스를 구축해야한다.
The purpose of this study is to propose ways to improve criminal profiling system in Korea by analyzing the changes of recent the UK and the USA criminal profiling system. The characteristics of the profiling system in the United Kingdom and the United States can be summarized as follows: First, although the UK is seeking to privatization of profiling, but the United States are placed in the work of NCAVC of FBI. Second, United Kingdom introduced in 2012, but the FSR have power relate about regulation of the standard of profiling qualifications and the profiler training. Also BRIU of NCAVC have same authority in United States. Third, both countries adopted the psychological condition, but the United States is widely recognized such as criminology, forensic science, sociology, and requires at least three years of work experience in the police and law enforcement agencies and the Federal Bureau of Investigation. Fourth, the FBI profiler work as a special investigator, and support the work of the federal criminal profiling and police investigation. Based on the characteristics of these two countries can offer the improvement of criminal profiling system in Korea. First, the government should constitute a tentative title National Forensics Bureau under the Prime Minister in charge of research and practice regarding the laws and technology, professional qualifications relating to forensic science. Second, the police should be introduced by regional profiling team system by reorganization of the investigation organization and reinforce the profilerThird, The police need to create a specific recruitment criteria and operate profiler internship programs in police agency, prison and probation institutes. Fourth, the retraining of profiler should be converted into an opportunity to share the mutual information such as brainstorming and discussing with the police investigation. Fifth, the incident and sharing of information provision should be strengthen and police profiler have to enable profiling authority in prison and probation institutes. Sixth, the police, prosecution, and National Forensic Service should be establish a database to share crime analysis information.
