정보주체의 개인정보자기결정권이란 그 권리의 객체가 되는 개인정보를 범주화하고 이에 대응하는 권능을 세분화·체계화함으로써 보호와 이용의 조화로운 법률관계를 형성하도록 하는 적극적 의미로 해석될 수 있기 때문에, 우선 국가 또는 민간사업자 등 개인정보관리주체에 대한 부정과 불신의 관념에서 벗어나 정당한 권리·의무의 법률관계로 형성할 수 있도록 하는 것이 중요한 것이다.
결과적으로 보호할 것은 두텁게 보호하고 이용할 것은 합리적으로 이용할 수 있는 제도적 체계의 확립을 위해서 개인정보에 관한 권리의 재정립이 요구된다 할 것이다. 이를 바탕으로 하지 않는 한 개인정보보호 전담기구의 창설은 유명무실해질 수밖에 없다.
따라서 한편으로 행정권한의 통제로서 또 다른 측면에서는 상충가치의 조율과 행정규제의 완화를 아울러 추진해나갈 수 있는 조직으로 개인정보보호 전담기구를 구성하여야 할 것으로 여겨진다. 이 글에서는 이를 위해 선진각국의 입법현실과 국회 행정안전위원회 대안에 나타난 개인정보보호 전담기구의 현황을 기초로 조직법적 논의와 작용법적 논구를 접목하여 바람직한 개인정보보호 전담기구의 창설을 위한 법이론적 쟁점을 되짚어보고 법정책적 방향에 있어서 개인정보보호에 관한 통합법 제정의 핵심사안으로서 개인정보보호 전담기구 설치문제를 조망한다. 다만, 국회 산하기구가 아닌 한 개인정보보호 전담기구는 행정조직법적 논리에 부합하게 구성되어야 하므로 행정작용법적 대응 역시 이에 수렴되어야 한다는 점이 고려되어야 할 것으로 본다.
