국민의 입장에서 훌륭한 법조인 양성은 매우 중요한 과제 중의 하나일 수밖에 없다. 사회가 복잡 다양해기면서 법률 분쟁이 증가하고 이에 따른 법률가의 수요 또한 지속적으로 증가하고 있다. 게다가 법치국가를 표방하고 있는 현재의 대부분의 국가에서 있어서 이를 지탱할 수 있는 가장 중요한 자산은 다름 아닌 우수한 법률가일 것이다. 따라서 법조인 양성은 단순히 직업으로서의 자격만을 수여하는 것이 아닌 국가의 정책적 문제가 된다. 이미 유럽에서는 로마부터 중세를 거쳐 근대와 현대에 이르기까지 자신들의 사회를 유지해나가기 위한 우수한 법조인 양성 제도를 발굴하기 위해 노력을 아끼지 않았다. 그중에서 독일은 우리가 특히 눈여겨보아야 할 나라이다. 일단 우리는 독일의 위주로 한 대륙법계를 계수한 나라이기 때문에 법률 문화나 교육방식이 독일로부터 크게 벗어나 있지 않기 때문이다. 그런데 사법개혁의 일환으로 우리와는 전혀 법체계가 맞지 않는 로스쿨 제도가 도입되어 시행되면서 크고 작은 문제들을 겪고 있다.
이에 로스쿨 제도에 대한 전면적인 재검토가 필요하게 되었다. 이와 관련하여 독일도 이미 과거에 영미식의 로스쿨 제도를 도입해 운영해 오다가 이를 전면 포기하고 학부위주의 법조인 양성시스템을 회귀했다는 역사적 사실은 우리에게 많은 시사점을 주고 있다. 이론으로서 법학을 배우고 이를 실무에 적용하는 대륙법계의 법조인 양성 모델은 필연적으로 많은 공부시간을 요구하고 있다. 더구나 국제화 시대가 도래됨에 따라 법조인들에게 더 많은 것들이 요구되고 이는 곧 법학학습기간의 장기화를 불가피하게 만들고 있다. 이러한 상황에서 비법학 전공 대상자들을 대상으로 3년이라는 단기간에 법조인을 양성하는 현행 로스쿨 시스템은 법조교육의 부실화를 피하기 어렵게 하고 있다. 그렇다면 우리도 독일처럼 기존의 사법시험으로 회귀하되 사법시험이 가진 문제점들을 보완하는 방향을 고민해 보아야 할 것이다. 그리고 이러한 방향성은 우리와 법체계가 같은 독일을 통해 새롭게 설정해 나가야 할 것이다.
The German legal education is separated into two stages. The first stage consists of legal studies at a university at least four years. This first stage is followed by a compulsory practical training (Referendarzeit) for two years. There is no law school system like that of the United States. Both stages end with the state bar examination covering the entire field of law. Traditionally, the Korean legal education followed the German models. The traditional Korean legal education has been divided into two parts: theory study and/or bar examination preparation at a college; and practical education and mandatory 2 year-training course at the Judicial Research & Training Institute (JRTI) to join the bar membership in Korea same as that of Germany. However, as a result of the bill passed in July 2007, the education system for legal studies has changed. The 2007 Act has adopted ta law school system similar to that of the United States. The main institutions for legal education in Korea are no longer the four-year colleges and the Judicial Research and Training Institute (JRTI), but chartered three-year graduate law schools. Considering the extremely short time period, I am skeptical about the Korean law school system. We could blame law schools for not educating their students well. The most serious threat to the success of the law school system might be Korean legal system like that of German. This can hardly be called progress.
