본 연구의 목적은 영유아교육 관련법령의 변천과정을 살펴보고, 여기에 나타난 유아교육과 보육의 의미를 분석하는 데에 있다. 현재 영유아교육 관련법령은 유아교육과 영유아보육으로 분리되어 규정되어있다. 이로 인해 유아교육 및 보육 현장에서는 많은 갈등과 혼란이 야기되고 있다. 특히, 영유아교육 관련법령에서는 유아와 영유아의 개념 정의가 경합을 벌이고 있으며, 교육과 보육의 개념 정의가 상충되어 있다. 이로 인해 영유아들은 헌법에 보장되어 있는 ‘균등하게 교육받을 권리’를 침해당하고 있다. 이러한 문제의 해결방안을 찾기 위하여 영유아교육 관련법령의 변천과정을 태동기(1949-1982년)와 통합기(1982-1991년), 분리기(1991-2004년), 재통합 모색기(2004년-현재) 등 4가지로 구분하여 살펴보았다. 그 결과 영유아교육 관련법령의 문제를 해소하고 영유아의 헌법상 권리를 보장하기 위해 영유아에 대한 교육 및 보육 기능이 통합된 ‘영유아교육’의 개념 정의를 새롭게 사용할 것과 관련법령의 통합입법 필요성을 도출하였다.
The purpose of the study is to analyze meaning of ‘early childhood education' and ‘care & nurture' that appear in change process of a laws and ordinances relevant to the young children education. A laws and ordinances relevant to the young children education are detached by early childhood education and child care & nurture. It is the apple of discord in young childhood education. Specially, It is infringed on ‘equally educated right' of the young children. Because definition of ‘early childhood' and ‘childhood' was competed, and definition of ‘education' and ‘care & nurture' was clashed. To look for solution of these problem, investigated meaning of quickening period(1949-1982) and integration period(1982-1991), separation period(1991-2004), re-integration groping period(2004-present) etc., examined dividing by 4. As a result, we may have to use concept of 'the young children education', that is 'a broad education' of integration of 'early childhood education' and 'child care & nurture'. And we may have to integrate of Early Childhood Education Act(ECEA), Child Care & Nurture Act(CCNA) to solved problem of a laws and ordinances relevant to the young children education.
