چکیده

تئوری و عمل میان شرایط و ضوابط اخراج بیگانگان در زمان مخاصمات مسلحانه و زمان صلح تفاوت قائل می‌شود. وقوع جنگ سبب می‌شود اتباع دولت متخاصم به‌عنوان اتباع دشمن شناخته شوند. در این شرایط، دولت متخاصم ممکن است اخراج این افراد را کاری سهل بداند و اخراج بیگانگان، به‌خصوص تعداد زیادی از آنها، در چنین وضعیتی محتمل‌تر است. اگرچه چنین اقدامی می‌تواند در شرایط مخاصمه برای بیگانگان بسیار سخت و ناعادلانه به‌ نظر آید، در رویۀ عملی دولت‌ها این‌گونه اخراج متداول است. اگرچه دولت‌ها با توسل به معیار امنیت داخلی یا نظم عمومی تا حد وسیعی از حق اخراج در زمان مخاصمات استفاده می‌کنند، به‌نظر می‌رسد قدرت اخراج بیگانگان به‌هنگام مخاصمات باید اختیاری خاص و محدود تلقی شود و تنها در زمان‌های ویژه‌ای به‌کار رود. در این نوشتار، پس از جست‌وجو در اسناد حقوق بشردوستانۀ بین‌المللی، اسناد حقوق بشری جهانی و منطقه‌ای، حقوق بین‌الملل عرفی، رویۀ قضایی و دکترین این نتیجه حاصل می‌شود که محدودیت‌های وارده بر اخراج بیگانگان در زمان صلح، به‌هنگام مخاصمات مسلحانه نیز باید رعایت شوند.

چکیده [English]

Enemy alien is used to refer to those aliens that are nationals of a country that you are fighting with. Theory and practice rightly distinguish between expulsion of alien in peace and war. A war will make nationals of your opposite state to enemy aliens. The belligerent state may consider it convenient to expel all of the aliens present in its country, including permanent or temporal residents. However this act may seem hard and unfair to aliens, but this has been accepted that this act is justifiable. International humanitarian law studies different situations including deportation or transfer of citizens such as aliens which are related to an armed conflict. However, states use this right largely by the excuse of internal security and public order. But the power of expulsion of aliens should be considered a special one and be used in special situations.
