이 글은 확산하는 마약류범죄에 대처하기 위해 마약류범죄의 수사와 관련된 형사법적 여러 논점에 대하여 살펴본다. 마약류범죄 수사를 위한 함정수사는 범의유발이라는 주관적 기준보다는 규범적·상황적 적정성이라는 객관적 기준으로 허용하되, 여기에는 마약류범죄의 특성을 고려한 필요성이 적극적으로 고려되어야 하며, 이러한 취지에서 위장수사나 온라인 수색과 같은 새로운 수사기법의 도입이 적극 고려되어야 한다. 아울러 현행 마약류관리법은 범죄구성요건을 중심으로 재정비하되 공급범죄와 수요범죄를 분리하여 규정하는 등의 개선이 필요하다.

This article examines various issues in criminal law related to the investigation of drug crimes among the various policy areas to deal with the spread of drug crimes. There is a phenomenon that the global trend of policy on drug crime is shifting from the regulation and punishment to the direction of management and treatment. However, it is still necessary for the state to find out the use and supply of drug and take public measures against it. And criminal justice agencies are at the forefront of these activities. In this respect, this article discusses several legal issues that can be raised in order to effectively find the supply and use of drug and to properly exercise the criminal justice system. Through this, we aim to improve the substance and efficiency of investigations into drug crimes, and at the same time, contribute to the advancement of the national response policy against drug. In conclusion, it is necessary to actively consider the specificity of drug crimes in the investigation method, acknowledge the necessity, and develop legislative and interpretive theories so that investigative agencies can use them legally.
