RE: [Metadata] Expressing other agreement terms

When I read Mark's note my thoughts immediately went to the CNI document
"NEGOTIATING NETWORKED INFORMATION CONTRACTS AND LICENSES" from the READI
Project (Rights for Electronic Access to and Delivery of Information). The
overall guide can be found at http://www.cni.org/projects/READI/guide/ and
the statement on Warranties at
http://www.cni.org/projects/READI/guide/warranties.html.
When reviewing the READI guidelines, understand that they are intended to
cover licensing of electronic and networked information, but do not
necessarily speak to a licensing process that has been automated. They *do*
speak to license elements or clauses that likely must be present in future
automated licenses. Specific to warranties, they provide *examples*:
* Assurances that the vendor has secured the rights to (or owns) the
information and has the authority to sell (or license) it all (or in parts)
* A limitation on the amount of down-time
* Support requirements for documentation, training, technical
support, customer service, etc. (see Technical Specifications)
* Billing in a timely fashion
* Speed of searches (time)
* Availability of backup copies in the event of failure of network
or other means of delivery
* Assurances of information availability beyond the term of the
contract (see also Definition of Product/Service, Termination)
Such stipulations could be part of the record of any automated license
transaction. Compliance with these stimpulations could be assured by system
design as well, but they need not be.
RE: Mark's comment that the question of Warranties is linked to the question
of document authenticity, perhaps but not necessarily. Are we talking about
the authenticity of the license arrangement or doc authenticity as a
warrany???
